Patent Policy — Plexus

MIT License 는 명시적 특허 grant 조항을 포함하지 않습니다. 본 문서는 Plexus contributor community 의 defensive patent 원칙과 자발적 non-aggression pledge 를 명시화합니다.

MIT License 와 특허

Plexus 코드는 MIT License 하에 배포됩니다. 특허 리스크는 라이선스 본문이 아니라 아래 contributor pledge, defensive patent 원칙, 그리고 사전 patent landscape 확인 절차로 관리합니다.

Termination — 특허 소송 시 커뮤니티 제재

MIT License 자체에는 자동 patent retaliation 조항이 없습니다. 다만 사용자가 본 프로젝트 또는 contributor 에 대해 특허 소송 (cross-claim 포함) 을 제기하면, Plexus community 는 해당 entity 의 contributor 지위, 상표 사용 허락, foundation sponsorship eligibility 를 즉시 재검토합니다.

보충 정책 (Plexus-specific)

Defensive Patent 원칙

Plexus Contributors 는 defensive patent 만 보유 / 출원 권장. 정의:

  • Defensive: 본인 / 본 프로젝트 / open source 생태계 보호 목적
  • Offensive (금지): open source 프로젝트 / 호환 제품 공격 또는 bullying 목적

Plexus contributor 가 offensive patent 행사 시 contributor 지위 박탈 (AUTHORS.md).

Patent Pledge — Plexus Contributors 의 자발 서약

Plexus founding contributors 는 다음 서약 (개별 contributor 의무 사항):

  1. 본 프로젝트 사용자에 대해 본인 보유 특허로 소송 제기하지 않음
  2. 다른 open source 프로젝트가 본인 특허를 침해해도 비공개 협상 우선 (소송 회피)
  3. 특허 매각 시 buyer 가 동일 서약 승계 조건 (FRAND-like)

본 서약은 법적 구속력 보다는 도덕적 commitment. 위반 시 contributor 지위 박탈 + 명단 공개.

Patent Non-Aggression Pledge — 외부 entity 권유

Plexus 와 호환 제품 / 후속 프로젝트 운영하는 외부 entity (회사 / foundation / 개인) 도 본 pledge 동의 권유:

We pledge that we will not assert any patent claims against any
Plexus contributor, Plexus user, or any open source project that
implements compatible specifications, except in defensive response
to litigation initiated against us.

동의 entity 명단: docs/legal/patent-pledges.md (Phase 7 가용).

Known Patents — 알려진 관련 특허

Plexus 의 기술 영역 에서 알려진 특허 (회피 / 사용 / 적용 라이센스 등):

  • (현재 없음 — Phase 6 audit 후 갱신)

Phase 6 (security audit) 시점에 Trail of Bits 또는 동등 entity 가 patent landscape audit 수행 예정. 발견 결과 본 섹션 갱신.

Contributor Patent Declaration

기여자가 본인 보유 특허로 침해 위험 인지 시점에 자발 신고 권장:

# PR 본문 또는 commit message 에 명시
patent-declare: US Patent 12,345,678 "Distributed Inference Method"
  — held by contributor, pledged for non-aggressive use toward Plexus users

위 신고는 법적 의무 아닌 transparency 권장.

Foundation Patent Management

Plexus Foundation (Phase 6-7 설립) 의 Patent Management 정책:

  1. No offensive patents: Foundation 자체는 offensive patent 보유 / 출원 금지
  2. Patent pledge permanence: Foundation 이 라이센스 변경 시도해도 contributor non-aggression pledge 는 별도 기록으로 유지
  3. Patent assertion review: contributor 가 본 프로젝트에 offensive patent 사용 의심 발견 시 TSC 가 30일 내 검토 + 공개 결정
  4. OIN (Open Invention Network) 가입 검토: Phase 7+ — Linux 생태계 cross-license pool 가입

Software Patent 정치

Plexus Contributors 는 software patent 자체에 대해 회의적 입장 (Free Software Foundation, EFF 등 정합). 그러나:

  • 현실에서는 software patent 가 존재
  • Defensive 보유가 ecosystem 보호에 필요한 경우 있음
  • Contributor non-aggression pledge + 사전 patent review 가 minimum viable defense

본 입장은 정치적 statement 아닌 pragmatic recognition.

Cryptographic Patents

본 프로젝트는 다음 암호화 기법 사용:

  • Ed25519 / X25519 / Curve25519: public domain (Bernstein) — patent-free ✅
  • BLAKE3: CC0 / Apache 2.0 — patent-free ✅
  • ChaCha20-Poly1305: public domain — patent-free ✅
  • SHA-2 / SHA-3: NIST 표준 — patent-free ✅
  • TLS 1.3: IETF 표준, RFC 8446 — patent-free ✅
  • TEE attestation (Intel TDX, Nvidia CC): vendor 특허 보유, attestation 사용은 vendor 라이센스 묵시 grant (사용자 hardware 구매 시점)

신규 암호화 기법 도입 시 patent landscape 확인 의무. lefthook cargo deny check 의 bans 섹션이 알려진 patented crate 자동 차단.

보고

다음 발견 시 Foundation 통지 의무:

  • 본 프로젝트 사용자 / contributor 에 대한 특허 소송
  • 본 프로젝트가 제3자 특허 침해 의심
  • 본 프로젝트에 patent troll bid (license shakedown)
